Information You Provide

Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. Information Third Parties Provide About You

In the event Data-Dynamix goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, including, without limitation, during the course of any due diligence process, we may share your Personal Information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Data-Dynamix’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by Data-Dynamix about our Site users is among the assets transferred. By providing your Personal Information, you agree that we may transfer such information to the acquiring entity without your further consent.

How Long We Hold Your Information

We will store your Personal Information indefinitely until you revoke your consent or request that the information be deleted via a verifiable consumer request as discussed below.

Rights You Have Regarding Your Personal Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

If we have sent you a promotional email, you may opt-out of receiving future promotional emails by following the instructions at the bottom of the emails. This opt-out does not apply to information provided to Data-Dynamix as a result of a purchase of a product or service, warranty registration, product service experience or other transactions.
  • Targeted Advertising: If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by writing us with your request at PO Box 2148, Fort Lauderdale, Florida 33303. For this opt-out to function, you must have your browser set to accept browser cookies.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Your Rights to Request Information

You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of Personal Information we collected about you;
  • The categories of sources for the Personal Information we collected about you;
  • Our business or commercial purpose for collecting or selling that Personal Information;
  • The categories of third parties with whom we share that Personal Information;
  • The specific pieces of Personal Information we collected about you (also called a data portability request);
  • If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:
    • Sales, identifying the Personal Information categories that each category of recipient purchased; and
    • Disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

However, we shall never, under any circumstance, disclose a consumer’s Social Security number, driver’s license number or other government-issued identification number, financial account number, any health insurance or medical identification number, an account password, or security questions and answers.

You also have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. Please understand that we cannot delete your Personal Information except by also deleting your user account.

If you are an EU Resident and you withdraw your consent to transfer Personal Information outside of the EU, we will immediately delete your Personal Information and therefore your user account when notice of your withdrawal is received.

If you delete your User Contributions from the Site, copies of your User Contributions may remain viewable in cached and archived pages, or may have been copied or stored by other Site users.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

To exercise the access, data portability, and deletion rights described above:

Please submit a verifiable consumer request to us by filling out the Verifiable Consumer Request Form and faxing or e-mailing the form to the destinations set out below. Only you may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request, and will promptly delete such Personal Information as soon as practical after processing your request, except as required to comply with the law.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize Personal Information sales. However, you may change your mind and opt back in to Personal Information sales at any time by visiting our website and sending us a message.

We will only use Personal Information provided in an opt-out request to review and comply with the request.

Response Timing and Format

We shall always confirm receipt of a verifiable consumer request within ten (10) days of its receipt. Further, we endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Data Security

Data-Dynamix takes commercially reasonable steps to help protect and secure the information we collect and store about our users. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We also urge you to be careful about giving out information in public areas of the Site like message boards. The information you share in public areas may be viewed by any user of the Site.

Please remember that the transmission and storage of information via the internet is not completely secure. The third party has agreed to implement technology and security features and strict policy guidelines to safeguard the privacy of your Personal Information from unauthorized access or improper use.

The Site may contain links to third-party websites, such as our pages available through third-party social media platforms. Data-Dynamix takes no responsibility for the content, operation or privacy practices of such websites. This Privacy Policy does not apply to third-party websites, and you should check the policies of any linked website before offering information to the sponsor of the website. Consent to Transfer
